News BREC Accepts District Attorney’s Finding, Will Cure Procedural Violation at Thursday Meeting

BREC has received the East Baton Rouge Parish District Attorney’s findings regarding the Commission’s July 23 meeting. The District Attorney determined that BREC had satisfied the written demand requirement necessary to discuss prospective litigation, but that the public agenda did not identify the parties and subject matter with the level of specificity required before the Commission entered executive session.

BREC accepts the finding and the Commission will reconsider the matter at its publicly noticed meeting Thursday, August 27, and take the appropriate action to cure the procedural violation.

“The public has a right to understand the business BREC intends to consider, including when the law permits a portion of that discussion to occur in executive session,” said BREC Superintendent Dr. Brooks Williams. “In this instance, the agenda should have provided greater specificity regarding the matter being discussed. We should have gotten that right, and we apologize that we did not.” Williams said BREC’s focus is now on addressing the issue and continuing to improve how the organization conducts the business of the public.

“Accountability requires us to acknowledge when something needs to be corrected and then correct it,” Williams said. “We will do that publicly on Thursday, learn from the experience, and continue working to earn the confidence of the people we serve.”
